By this application, the applicant is seeking relaxation of costs imposed by this Court vide order dated 12/01/2023.

While passing order on 12/01/2023, this Court has observed that remark of Registry shows that copies of deposition and other documents have not been filed. Office objection has not been removed till date. 4.

The appellant, therefore, was directed to remove the office objection within a period of two weeks, failing which, the appellant was directed to deposit the costs of Rs.10,000/-.

Learned Counsel for the applicant submitted that only two days delay is caused for removing the office objection and supplying the copy.

The delay was inadvertent and not intentional one and requested for relaxation of the amount of the costs.

The appeal is of the year 2010. Till 2023, i.e. for 12 years the appellant has not removed the office objections, and therefore, costs is imposed by this Court. 8.

Considering the reasons mentioned in the application, it would be appropriate to reduce the costs up to 50% i.e. Rs. 5000/-.

The appellant shall deposit the costs of Rs.5000/- with the High Court Legal Services SubCommittee, Nagpur. 10.

The application is disposed of.

CRIMINAL APPEAL NO.122 OF 2010 Place the appeal for final disposal after two weeks.
