Mr. Sambre, learned counsel for the respondent No.1, on instructions, makes a statement that the respondent No.1 is ready to fill the backlog of vacancy of Assistant Registrar reserved for PWD category.

In that view of the matter, the first prayer clause (i), seeking the same relief, does not survive.

As far as second prayer clause (ii) made in the present petition to direct the respondents to consider and grant the petitioner's claim for promotion to the post of Assistant Registrar (PWD category) with deemed date with effect from 04.10.2021 (date of DPC) or in the alternative from 01.11.2021 and to grant her all consequential service and monetary benefits, can be asked to be considered and decided by the respondent No.1 in light of the provision under Section 32 of the Rights of Persons with Disabilities nd.thawre
2/2 Act, 2016.

Accordingly, we dispose of the present petition by accepting the statement made as regards the prayer clause (I), by the learned counsel for the respondent No.1 and further direct the respondent No.1 to take decision as regards claim of the petitioner for promotion to the post of Assistant Registrar reserved for PWD category with deemed date, within 10 weeks from the date of furnishing the copy of this order to the respondent No.1. 6.
The petitioner is directed to submit detailed written submission to the respondent No.1, claiming such promotion within one week from today.

The petitioner shall furnish copy of this order to the respondent No.1 within two weeks from today.
