By this writ petition, the petitioner has prayed that he be transferred permanently from Nagpur Open Prison to Paithan Open Prison, District Aurangabad.

The learned Additional Public Prosecutor has tendered a communication dated 14.12.2022 issued by the Jail Superintendent in which it is stated that though some convicts having found entitled to be transferred to Paithan Open Prison, they are not yet transferred for want of necessary facilities. It is further stated in the said communication that as and when such facilities are available at the Paithan Open Prison, District Aurangabad, necessary decision in that regard can be taken.

The said communication dated 14.12.2022 is taken on record and marked 'A' for identification.

In view of aforesaid, the writ petition is disposed of. Needless to state that it is open for the petitioner to pursue the aforesaid request in accordance with law.
