Advocate Dhok submits that caste certificate submitted by petitioner for grant of validity is still being looked into by respondent no.1. He, therefore, seeks time frame for disposal of that matter and appropriate interim order to protect admission and education of petitioner.

Learned AGP appearing for respondent nos. 1 to 3, upon instructions, states that efforts will be made to decide caste claim within 8 months. Advocate Ghurde appears for respondent no. 5. This court has on 27.11.2015 while issuing notice in the matter protected education of petitioner. That interim order continues to operate even today.

wp6373-15 In this situation, we direct petitioner to appear before respondent no.1 committee on 10.5.2016 and abide by its further instructions in the matter.

The respondent no. 1 Scrutiny Committee shall complete verification of caste claim of the petitioner in accordance with the Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes ( Vimukta Jatis), Nomdic Tribes, Other Backward Classes and Special Backward Category ( Regulation of Issuance & Verification of ) Caste Certificates Act, 2000 ( Act no. XXIII of 2001) within 8 months thereafter.

Interim order granted by the court on 27.11.2015 shall continue till the decision on the caste claim and shall be subject to it.

Writ petition is partly allowed and disposed of. No costs.
