Applicant - Nasirkha @ Baba Dhabekar s/o Ajij Kha is present along with his Counsel. He is respondent no.3 in the Criminal Appeal. Prayer is to recall the order of warrant.

After hearing the learned counsel for the applicant, we are satisfied that he needs to be treated on the same lines, and accordingly we extend him the treatment accorded to respondent nos. 4 to 6 on 10.10.2016.

Order 2710appa716.16 Khan shall execute a fresh bail before the trial Court on same terms and conditions within a period of two weeks. As an additional condition, he shall also remain present along with his counsel on the dates of hearing of the present Criminal Appeal. Undertaking to that effect shall be filed by him as also by his surety before the Trial Court. 4.

Registry to attempt to obtain report of warrant issued for securing attendance of respondent no.1 Sk. Mehmood.

Criminal Application No.716/2016 is accordingly allowed and disposed of. No costs. 6.

The Appeal be listed for hearing 28.11.2016 as already ordered.
