Face with the obstacle that the Co-ordinate Benches have upheld the policy including a Co-ordinate Bench of which one of us (R. B. Deo, J.) was party, the learned counsel for the petitioner submits that the issue is pending before the Supreme Court, and that the petitioner may be permitted to withdraw the petition with liberty to approach this Court again, subject to the outcome of the pending Special Leave Petition.
