Perused the First Information Report with the assistance of learned counsel for the applicant.

According to the First Information Report, the decoity has been committed by some unknown persons. This applicant, however, has not been identified by the complainant or any of the witnesses present on the spot at the relevant time. No recovery under Section 27 of the Evidence Act has been effected from this applicant. The charge-sheet has also been filed. In the circumstances, I am inclined to allow this application.

Application is allowed and it is directed that the applicant be released on bail in Crime no. 334/2015 registered with Police Station, Paratwada for the offences punishable under Sections 395 and 412 of the Indian Penal Code on furnishing PR Bond of Rs. 15,000/- together with one solvent surety in the like sum, on the following conditions :

(i) Applicant shall attend the trial Court regularly on all dates of hearing.

2 ba936.16 (ii) Applicant shall cooperate the trial Court in expeditious disposal of the trial.

(iii) Applicant shall not tamper with prosecution evidence in any manner.

Application is disposed of.
