By this Writ Petition, the petitioner seeks a direction against the Scrutiny Committee to decide the caste claim of the petitioner within a time-frame. The petitioner seeks a direction against the respondent no.4- College to protect the education of the petitioner till his caste claim is decided. Shri Nikhil Joshi, the learned Assistant Government Pleader appearing for the respondent nos.1 to 3 states that the caste certificate submitted by the petitioner was not in form 'C' and hence the same was returned to the petitioner in terms of the order dated 30.8.2016. It is however, fairly stated that in view of the orders passed by this Court from time to time, reversing similar orders passed by the Scrutiny Committee refusing to verify the caste claims, if the petitioner resubmits the caste claim to the Scrutiny Committee for verification, the Scrutiny Committee would decide the same as early as possible.

16.12.wp.6373.16 Shri A.S. Sonare, the learned counsel for the petitioner states that the petitioner would resubmit his caste claim to the Scrutiny Committee within one month.

In view of the aforesaid, the Writ Petition is allowed. The petitioner is directed to resubmit his caste claim to the Scrutiny Committee within one month. The Scrutiny Committee is directed to decide the caste claim of the petitioner within one year. The respondent no.4-College is directed to protect the education of the petitioner till his caste claim is decided. Order accordingly. No costs.
