The non-applicant filed complaint against the present applicants. The said was registered as Complaint Case No.2834/2016. The learned Judicial Magistrate First Class, (Court No.2),Nagpur on 24/09/2016 issued process against the applicants and other accused persons for the offence punishable under Sections 420,468,472,506 of the Indian Penal Code.

Against the said order a revision is preferred by the present applicants. That is registered as Criminal Revision No.219/2016 and is pending on the file of learned Additional Sessions Judge-2,Nagpur. In the said revision, the learned Additional Sessions Judge-2,Nagpur on 21/10/2016 issued notice to the non-applicant in the said revision. The said order of only issuance of notice in the revision is questioned in this application by the present applicants.

apl.749.16.odt This Court on 25/10/2016 granted ad-interim stay in terms of prayer clause (ii) of this present application. The non-applicant no.1 is served, however learned counsel for the non-applicant no.1 remained absent today. The order which this Court is propose to pass can be passed even in the absence of learned counsel for nonapplicant as there will be no prejudice to the non-applicant no.1.

ORDER

I) The learned Additional Sessions Judge-9,Nagpur on whose file Criminal Revision No.219/2016 is pending is hereby directed to decide the said criminal revision within a period of two months from today.

II) The parties to the revision are directed to extend full co-operation to the learned Revisional Court. III) In view of the fact that the interim order was passed on 25/10/2016 and it is in operation as on today the interim order dated 25/10/2016 is hereby extended further for the period of two months. After expiry of two months the interim order passed on 25/10/2016 shall stand cease automatically.

IV) The application is disposed of.
