Shri Pathan, learned Additional Public Prosecutor submits that "C" summary is already filed in this case before trial Court.

Record reveals that on 19/6/2019 this Court had directed trial Court to pass suitable order on "C" summary considering that period of one year had already lapsed after filing of the same and no orders were passed.

Shri Padhye, learned Counsel for applicants, today has filed pursis along with order of learned trial Court dated 2/7/2019 whereby "C" summary is accepted.

In that view of the matter, we find no reason

1007apl875.18 2/2 to grant time as prayed by learned Counsel for respondent no.2. We also do not find any reason to keep this application pending, which is filed for quashing of Criminal Case No.1294/2016 pending before learned Judicial Magistrate, First Class, Akola. From the order of trial Court, it is found that respondent no.2 had contested the "C" summary proceedings.

In the circumstances, criminal application is disposed of as rendered infructuous.
