DATED : 22-06-2015 Heard Shri D.N. Mehta, the learned Advocate for the applicant (original respondent No.1) and Shri S.P. Bhandarkar, the learned Advocate for the original petitioner. There was no appearance on behalf of the original respondent Nos. 2 and 5 when the writ petition is decided. The original respondent Nos.3 and 4 are not the contesting parties as recorded in the judgment dated 17-04-2015.

The original respondent No.1 has filed this application/counsel note praying for speaking to minutes, stating that at the time of disposal of the writ petition, it transpired that the trial Court has to be directed to dispose the civil suit till 30-09-2015, however it has not be incorporated in the judgment. Shri S.P. Bhandarkar, the learned Advocate for the original petitioner accepts this factual position.

In view of the above, the Civil Application/

2 counsel note 5436.15 Counsel Note Stamp No.5436 of 2015 is allowed. In the judgment given in Writ Petition No.6388 of 2014 on 17-04-2015, in paragraph 5 following clause be added as clause No.(vi) :

"vi. The learned trial Judge is requested to dispose of the civil suit till 30-09-2015." The office is directed to incorporate the above corrections in the judgment and supply the certified copy to the original petitioner and the respondent No.1. The civil application/counsel note is allowed in the above terms.
