JUDGE LATER ON After the order was passed in the morning session, the accused is produced at 3:10 p.m. Shri A.J. Mirza, Advocate appears on behalf of the accused and seeks time.

2 appeal96.05 By the order dated 11th February 2005, this Court directed that the accused be released on bail on furnishing PR Bond for Rs. 25,000/- and one solvent surety in the like amount. On 5th September 2018 when the matter was listed the Court noticed the office note pointing out the bail writ received with the report that the accused has not furnished bail. Therefore, the order dated 5th September 2018 came to be passed directing issuance of non-bailable warrant against the accused. Today also, the application praying that the accused be released on bail is not filed. Hence, the accused Shivlal s/o Bhimrao Dahare be sent to Central Prison, Nagpur.

JUDGE LATER ON CRIMINAL APPLICATION (APPA) NO. 925/2018 On deposit of Rs. 10,000/- towards cash surety, the appellant/accused be released on bail.

Registry may accept the cash surety if possible today itself.

List the appeal for hearing on 06/10/2018.

The appellant shall remain present before this Court on 06/10/2018 at 10:30 am.
