It appears that the name of said defendant No.4 came to be deleted during pendency of the appeal. As the suit is for partition and separate possession and the prayer made in the application is not opposed by the learned Counsel for the appellant, the application is allowed. The applicant is permitted to be impleaded as respondent No.4.
