By this writ petition, the petitioner has sought a declaration that the petitioner is eligible for the appointment on the post of Lecturer in District Institution of Education and Training. According to the petitioner, the rejection of the candidature of the petitioner by the Maharashtra Public Service Commission is bad in law.

Shri Joshi, the learned Assistant Government Pleader appearing for the respondent no.1, raises an objection to the tenability of the writ petition. It is stated that in stead of filing an Original Application before the Maharashtra Administrative Tribunal, the petitioner has filed the instant petition. By upholding the preliminary objection raised on behalf of the respondent no.1, we decline to entertain the writ petition. The writ petition stands disposed of as withdrawn. The points raised in the writ petition are kept open.
