The learned counsel for the appellant, on instructions, seeks leave of the Court to withdraw the appeal with permission to file bail application before the Trial Court on the ground of change in circumstance as during the pendency of this appeal, charge-sheet came to be filed and that the primary reason for rejection of the previous bail application by the learned Additional Sessions Judge, Khamgaon, was that the investigation was in progress.
Leave to withdraw the appeal with liberty, as prayed for, is granted.
Disposed of accordingly.
