-VERSUSThe Collector, Nagpur and others.
Office notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's Orders or directions and Registrar's orders.
CORAM : B. P. DHARMADHIKARI AND A.D. UPADHYE, JJ.
DATE : MARCH 16, 2018.
Heard Shri P.S. Kshirsagar, learned Counsel for the applicants and Ms. N.P. Mehta, learned A.G.P. for Non-applicants.
2.
By a reasoned order Writ Petition No.
2352/2017 has been disposed of. Now a document is placed on record urging it to be a sanctioned map. Said document at Annexure-2 (Page No.17 with M.C.A.), does not reveal to us the necessary endorsement and sanction. Learned Counsel for applicants submit that it is sanctioned by the Tahsildar.
Order 1603cao1453.17 However, under which provision it is sanctioned, is again not clear.
3.
The document which should have been filed along with the Writ petition is now tendered and justification of its belated production is of non availability. The document also does not show that it is a sanctioned plan. In this situation, no case for review and therefore, for condonation of delay is made out.
Civil Application is, therefore, rejected. Consequently, Misc. Civil Application also stands rejected. No cost.
