Heard.

The applicant is apprehending his arrest in connection with crime No.535/2015 registered with Police Station Gittikhadan, Dist.Nagpur for an offence punishable under Sections 363, 452, 323, 504, 506 read with Section 34 of the IPC.

Perused the FIR as well as reply filed by the State. Looking to the status of the applicant and nature of the allegations against him about criminal trespass etc., I do not think it would be necessary to have him arrested. For the apprehension expressed by the State in paragraph 6 of the reply, conditions can be imposed.

In view of above, I make the following order.

ORDER

(i) Criminal Application (ABA) No.623/2015 is allowed.

aba623.15 (ii) In the event of arrest in connection with crime No.535/2015 registered with Police Station Gittikhadan, Dist. Nagpur for an offence punishable under Sections 363, 452, 323, 504, 506 read with Section 34 of the IPC, applicant-Sumit Kishor Gandhi be released on bail on his executing P.R. Bond in the sum of Rs.10,000/- with one surety in the like amount.

(iii) The applicant shall attend Police Station, Gittikhanda, Nagpur as and when called by the Investigating Officer.
