Criminal Application No. 742/2015 Heard learned counsel for the applicant.

The applicant has undergone almost eleven months of imprisonment and the sentence awarded to him is three years. Looking to the nature of the matter, I think, care can be taken by asking the applicant not to enter boundaries of Bhadrawati town and stay at some other place by intimating the Police Station, Bhadrawati. Hence, following order is passed:

ORDER

(i) Criminal Application No.742/2015 is allowed.

(ii) The substantive jail sentence awarded to the applicant-Prakash Kolte shall remain suspended.

appa742.15 (iii) The applicant-Prakash Kolte shall be released on bail. Bail as in lower Court.

(iv) The applicant shall not enter boundaries of Bhadrawati town till the appeal is decided and shall stay at some other place with an intimation to Police Station, Bhadrawati.
