Heard Shri V.G. Bhamburkar, learned counsel for the petitioner and Shri S.D. Shirpurkar, learned APP for respondent Nos. 1 & 2.

We are not inclined to go into more details of the controversy. Prima facie, it appears that no inquiry has been made from the persons named as eye witnesses by the petitioner.

The learned APP is seeking time to obtain instructions in this respect.

The witnesses are named in the initial report and reply has been filed in this Court sometimes in December 2016. Thus, in reply, the reason for not inquiring from those persons or then outcome of inquiry, if any, made with them could have been pointed out. On the contrary, reply reveals some other names.

In this situation, we direct respondent No. 1 to inquire from the persons named as witnesses by the petitioner and such other persons, as the respondent finds necessary and thereafter submit a report to the competent Court.

Accordingly, Criminal Writ Petition is partly allowed and disposed of. However, there shall be no order as to costs.
