It is submitted by the learned advocates representing the parties that the non-applicant no. 2 (a) also agrees to the terms of settlement as stated in the pursis however, she could not sign the pursis because she is at Mumbai and unable to come to Nagpur. It is submitted that the parties who have signed the pursis are present in the Court and they assure that non-applicant no. 2 (a)-Arti Wd/o Amit Patki would sign the pursis before the Registrar (J.) of this Court within two weeks. It is prayed that the settlement be recorded and the applicant be permitted to withdraw the application.

The application is disposed as withdrawn. In the circumstances, the parties to bear their own costs. The request made on behalf of the parties to direct the trial Court to dispose the Spl.C.S. No. 612/2013 expeditiously, is accepted.

The learned trial Judge shall dispose the civil suit expeditiously and in any case till 30/11/2018, especially considering the fact that the civil suit is of 2013. C.A.O. No. 1846/2015 In view of disposal of miscellaneous civil application, this application seeking permission for amendment does not survive. It is disposed accordingly. No costs.
