Heard both the learned counsel for the respective parties.

Two applications are filed for transfer the proceedings between both the parties. The applicant, who is the husband of the non-applicant has filed the Misc. Civil Application (Tr) No.1034 of 2023, to transfer the proceedings, which are pending before the Judicial Magistrate First Class, Narkhed. Four
2 / 3 61.MCA (Tr) No. 1034-2023 proceedings which are pending before the Narkhed Court, one for Domestic Violence Petition and one for maintenance application and the execution proceeding in both the matters.

The applicant has filed the application to transfer the said proceedings before the Judicial Magistrate First Class, Bhandara, as he is staying at Bhandara and is having some medical problem and it is not possible for him to travel from Bhandara to Narkhed.

The applicant in another application i.e.
in Misc. Civil Application (Tr) No.81 of 2025, the wife has filed the application to transfer the proceeding, which is pending before the Family Court, Bhandara filed by her husband for divorce petition to transfer to Narkhed or at Nagpur, as she can travel at Nagpur and both the parties have stated that they have no objection, the proceedings in both the Courts are transferred to Nagpur Court, as it is convenient for both of them to attend the Court. 5.
Considering the consent of both the parties for transferring the proceedings before the Nagpur Court as it is convenient for both of them.

The Petition bearing No.A-128 of 2024, which is pending before the Family Court, Bhandara is transferred to the file of Family Court, Nagpur and the proceedings which are pending before the Judicial Magistrate, First Class, Narkhed are transferred to the file of Chief Judicial Magistrate/ Special D.V. Court, Nagpur.

Both the Misc. Civil Application (Tr) No.
1034/2023 and Misc. Civil Application (Tr) No.81/2025 stands disposed of.
