The Petitioner seeks inclusion of his name in the final voters' list to enable him to either contest or participate in the election for Gram Panchayat, Kamtha, Tah.& District Gondia. It is, however, seen that as per the order issued by the State Election Commission, only those voters whose names are included in the voters' list for the concerned Vidhan Sabha constituency on 31.05.2022 are entitled to right of voting in the present election. It is not in dispute that the Petitioner's name does not figure in the said voters' list that was published on 31.05.2022. Hence, at this stage, when the election programme is underway and the filing of nomination has commenced, the relief that is prayed for cannot be granted in the present writ petition. It is, however, noted that in the provisional voters' list that was published subsequently on 09.11.2022, the Petitioner's name has been included with effect from 01.01.2023. In that view of the matter, no relief can be granted to the Petitioner
WP.7422.22 presently. The Writ Petition is dismissed. No costs. [ANIL L. PANSARE, J.] [A.S.CHANDURKAR, J.] sahare BHAGWANTRAO SAHARE Location:
