The applicant is arrested on 13th January, 2018 in connection with Crime No.21/2018 registered by the non-applicant for the offence punishable under Sections 376(i), 377 of the Indian Penal Code and Sections 4 and 12 of the Protection of Children from Sexual Offences Act, 2012.

The F.I.R. is registered on the complaint lodged by mother of victim, the victim being about 13 year old. The investigating agency has pointed out that F.I.R. came to be registered against the applicant, after obtaining the report of medical examination of the victim and after recording the statement of victim. According to the investigating agency, the applicant resides in the neighbourhood of the complainant and victim.

2 ba862.18 It is argued by the learned Advocate for the applicant that charge-sheet is filed on 6th April, 2018 and further custody of applicant is not necessary, considering the facts of the case, I am not inclined to grant the prayer made in the application. The application is dismissed.
