Pursis Stamp No.04/2021, dated 27/09/2021 is filed on record by the learned counsel for the respondent Nos. 1 to 4 along with Joint Compromise Pursis, dated 23/07/2021, signed by the parties to the present appeal. In the Joint Compromise Pursis, terms and conditions are stated and one of the terms and conditions is about waiver of decreetal amount by the respondent Nos. 1 to 4.

In that view of the matter, the Second Appeal is disposed of.

The Decree shall be modified accordingly in view of the Joint Compromise Pursis.

As the matter is amicably settled between the parties, the appellant-Pandurang Vishwanath Nimkar is permitted to withdraw Rupees Fifty Thousand, deposited
