This is an application for modification of condition No. 6 in the bail order dated 31.07.2023. It is seen that as per this condition the applicant/accused No. 1-Gopal Krishna Banka S/o. Late Sukhdeo Lal Banka is directed not to leave India without prior permission of the Court. It is the case of the applicant/accused No.1 that he intends to go to a Bangkok with his family members. It is stated that, in fact, he has booked the tickets. It is seen that he has booked tickets for journey to Bangkok well in advance, without obtaining prior permission from this Court. As such, it is seen that he has missed his flight to Bangkok today. It needs to be stated that it was the fault of the applicant/accused No.1 in

13.appp.1669.2023.odt making his travel arrangements without applying for permission.

Be that as it may, in view of the condition imposed by this Court he cannot leave India without permission of this Court. The question is whether he can be denied the permission to leave India. I have gone through the record and proceedings and the order whereby this condition came to be imposed. Learned Advocate submits that the applicant will return back to India on or before 28.10.2023. This statement is recorded. Accordingly, the application is allowed in following terms:

(i) Applicant- Gopal Krishna Banka S/o. Late Sukhdeo Lal Banka is allowed to travel to Bangkok. (ii) Applicant shall return to India on or before 28.10.2023.

(ii) On his return to India, he shall attend the police station and submit his journey tickets as well as the copy of his visa indicating the departure and arrival stamps/entries.

The criminal application stands disposed of, accordingly.
