Heard learned counsel for the rival parties.

Seen the First Information Report; so also the impugned order.

Looking to the contents of the F.I.R., it is clear that the applicant had given a blow on the legs and some other person had given a blow on the head. There is no fracture on the head, but there is haemorrhagic contusion. The applicant is in jail since 11th November, 2015.

Looking to the nature of the injuries sustained, I am of the view that the detention of the applicant in jail is not necessary. Hence, the following order:

ORDER

(i) Criminal Application No. 893/2015 is allowed.

2611.ba.893.15 (ii) The applicant is ordered to be released on bail in the sum of Rs. 10,000/- with one solvent surety in the like amount, with further conditions that he shall cooperate with the Investigating Officer as and when called and shall not tamper with the prosecution evidence.
