Heard learned counsel for the rival parties.
In connection with Crime No. 277/14 registered with police Station, Mangrulpir, Distt. Washim, for the offences punishable under Sections 307, 377, 498-A, 323, 504 read with Section 34, Indian penal Code, the applicant was arrested on 17th February, 2015 and is in jail since then.
Perused the order impugned as well as FIR and so also the statements of the witnesses.
Undoubtedly, the applicant played a mischief with his wife endangering her life, which is clear from record. But then, till the trial is decided, no conclusion can be reached as to the nature of offence committed by the applicant. Since the charge-sheet has been filed, detention of the applicant is not now necessary. The wife of the applicant resides at the place of her father, away from the place where the applicant presently resides. Hence the following order:-
O R D E R
[a] Criminal Application No. 894 of 2015 is allowed.
[b] Applicant shall be released on bail upon furnishing a Personal Bond in a sum of Rs.
20,000/- [rupees twenty thousand only] with one surety in the like amount.
[c] Applicant shall report to Mangrulpir Police Station on last Sunday of every month between 02.00 p.m., and 4.00 p.m.
[d] The applicant shall not enter the limits of village Padit Takmor, Tq. & Distt. Washim, till the trial is over.
[d] The applicant shall not pressurize or influence the prosecution witnesses or tamper with the prosecution evidence. Any
such act on the part of the applicant shall lead to recall of this order.
