2] In view of no objection, delay caused in preferring the present appeal stands condoned. Civil application is allowed accordingly. No costs. 3] The judgment delivered by the M.A.C.T., Nagpur awarding compensation of Rs.2,04,000/- with interest is under challenge in the present appeal. 4] The learned Counsel for the appellant / insurance company submits that the parties have amicably settled the matter and the respondents / claimants have agreed to receive an amount of Rs.2,00,000/- towards full and final settlement.
2 fast22110.17 5] The aforesaid contentions are not objected by the learned Counsel for the respondents / claimants, rather consented and it is submitted that the appeal can be disposed of after recording its consent to the aforesaid settlement. It is prayed that directions to the appellant be issued to deposit the entire amount of compensation in this Court, as agreed above.
6] Shri Jaiswal, learned Counsel for the appellant, on instructions, submits that in addition to the amount which is deposited, the remaining amount will be deposited in this Court within two weeks from today. Since the statement is made on instructions, same is accepted as an undertaking.
7] The appeal stands disposed of in the above terms.
8] Needless to clarify that the respondents / claimants will be entitled to withdraw the amount. As consequences of above, all pending applications also stand disposed of.
