This is an application filed on behalf of respondent no.1 for withdrawing the amount of compensation deposited by the appellant before this Court. It is a matter of record that the appellant has deposited an amount of Rs.66.14,416/- in this Court while earlier the appellant had deposited an amount of Rs.38,14,169/- before the Reference Court.

The respondent no.1 has already withdrawn the said amount which was lying in deposit before Reference Court. Considering the said fact and the reasons given in the present application for permission to withdraw the amount, it would be in the interest of justice that the respondent no.1 is permitted to withdraw 50% of the amount deposited in this Court by the appellant.

Accordingly, this application is partly allowed

FA465-19.odt and the respondent no.1 is permitted to withdraw 50% of the amount deposited in this Court on furnishing usual undertaking before the learned Registrar (Judicial) within a period of four weeks from today. Application is disposed of.
