Apprehending arrest in connection with Crime No.357/2018 registered by the non-applicant for the offence punishable under Sections 143 and 353 of the Indian Penal Code, the applicants have sought pre-arrest bail. According to the investigating agency, the accused alongwith some unnamed persons forced their entry in the office of Nagpur Municipal Corporation and removed portraits, protesting against the demolition of drive of Nagpur Municipal Corporation for unauthorized / illegal religious structures.

2 aba663.18 The applicants claim that any other crime / offence is not registered against them. By order dated 19th September, 2018 in Criminal Application (ABA) No.663/2018 and by orders dated 24th September, 2018 in Criminal Application (ABA) Nos.669/2018 and 670/2018 this Court granted interim protection to the applicants imposing condition that they will attend the police station. There is no complaint by the investigating agency that the applicants have misused liberty and / or have not co-operated with the investigating agency. In the facts of the case, order passed by this Court on 19th September, 2018 in Criminal Application (ABA) No.663/2018 and orders dated 24th September, 2018 in Criminal Application (ABA) Nos.669/2018 and 670/2018 are confirmed.

The applications are allowed accordingly.
