Date : 17 th November, 2016 The civil suit was filed in the year 1997. The proceedings were stayed under Section 10 of the Code of Civil Procedure. The plaintiff entered the witness-box even before the issues were framed. After the stay was vacated, the proceedings commenced and the application for recall of the plaintiff as witness for cross-examination has been allowed by the Trial Court by imposing the costs of Rs.7,000/-. No interference is called for. The petition is dismissed.
