So far as the question relating to the power of Municipal Council to allot the work of assessment of municipal taxes to a private contractor is concerned the issue being sub judice before the Apex Court, the hearing on this issue is deferred till the decision of the Supreme Court. To this extent liberty is granted to the parties to move this Court for early hearing, if occasion arises.

Shri Khapre, learned Senior Advocate for the petitioner submits that the award of the contract has also been questioned on mala fides and according to him, the petition can be heard finally on this aspect of the matter, however, he submits that he would take instructions from the petitioner and revert to the Court on the next date. 4.

Civil Application (CAO) No.472/2021 to be heard on the next date.
