This is an application filed by the applicant to transfer the matter which is pending before the Civil Judge Senior Division, Khamgaon, District - Buldhana, to the Civil Judge Senior Division, Akola.

Learned counsel appearing for the applicant has stated that the applicant is staying at Akola, though the distance between Khamgaon and Akola is 53 Kms, it is dangerous for her to attend the Court at Akola. The non-applicant assaulted her, when she was staying at Akola with her sister, therefore, it is not possible for her to travel from Akola to Khamgaon and hence, prayed to transfer
2 / 3 44.mca933.2024 the matter, which is pending before the Civil Judge Senior Division, Khamgaon, Dist. Buldhana, to the Civil Judge Senior Division, Akola.

Learned counsel appearing for the nonapplicant has stated that the distance between Khamgaon to Akola is 53 Kms. She has assaulted the non-applicant and his mother. The complaint was lodged by his mother and she had bleeding injury. She has further stated that the matter is fixed for final arguments and at this stage, this application is filed to transfer the matter.

Learned counsel for the applicant stated that the Hon'ble Apex Court has observed to see the convenience of the woman, who files the application for transfer in matrimonial matter.

Heard both learned counsel for respective parties.

The application filed by the applicant at the fag end of the proceeding, the matter is fixed for argument. For argument, the presence of applicant is not required and moreover, video-conferencing is available now. Therefore, there is no need to transfer the matter from Khamgaon to Akola, which is 53 Kms away.

Hence, the miscellaneous civil application is rejected.
