Heard Shri M. Anilkumar, learned counsel for the petitioner, Shri Agnihotri, learned counsel for respondent No. 1 and Shri Sanyal, learned counsel for respondent No. 3.

Though various challenges are raised in the petition, it is not necessary at this stage to consider the same.

Insofar as levy of service charges by Respondent No. 1 is concerned, it is submitted by the learned counsel for respondent No.1 that the local office has forwarded the proposal in that regard to the head office and the same is stated to be pending before the High Power Committee. Similarly, as regards environmental clearance to the unit of the petitioner is concerned, it is stated that recommendation in that regard is also pending with Respondent No. 2, which has also heard the representative of the petitioner.

281wp366.14 In the aforesaid facts, the following order is passed:

1.

Respondent No. 1 shall take a decision with regard to levy of service charges in relation to the petitioner's unit within a period of eight weeks from today.

2.

Similarly, Respondent No. 2 - Ministry is directed to take a decision on the proposal for environmental clearance within a period of eight weeks from today.

The learned counsel for the petitioner undertakes to communicate this order to Respondent No. 2 by E-mail as well as by Speed Post with acknowledgment due.

It is made clear that the rival contentions of the parties are kept open.

With aforesaid directions, writ petition stands disposed of. No order as to costs.
