Nita wd/o Nitin @ Niketan Patil for condonation of delay in filing setting aside abatement application and for bringing the legal heirs of the appellant on record. According to her, the sole appellant died during pendency of this second appeal on 08/06/2014.

For the reasons stated in the applications and in the larger interest of justice, the applications are allowed. The delay is condoned. Abatement is set aside. Proposed legal heirs of the appellant be brought on record. Necessary amendment be carried out within a period of one week from today.
