The applicant has filed this application to transfer Hindu Marriage Petition No.403 of 2023 filed by the non-applicant, pending before the 7th Joint Civil Judge, Senior Division, Chandrapur to the file of Civil Judge Senior Division, Gadchiroli. 2.
The applicant is staying at Dongargaon and Gadchiroli is nearest place to her. As she is staying at Dongargaon and Gadchiroli is 30 Kms. away from her home, she has prayed to transfer the Hindu Marriage Petition No.403 of 2023 pending before the Court of 7th Joint Civil Judge, Senior Division, Chandrapur to Civil Judge, Senior Division, Gadchiroli.

The learned counsel for non-applicant has stated that, she has filed the Right to Information (RTI) applications where she has given her address as Bramhapuri, therefore, if the matter is transferred to Warora it will be convenient for both of them. 4.
The learned counsel for the applicant denied that, she is staying at Bramhapuri and stated that she is staying at Dongargoan and it is convenient for her to appear before the Court of Civil Judge, Senior Division, Gadchiroli.

Heard both learned counsel.

As the applicant is staying at Dongargaon and it is 30 kms away from Gadchiroli, Hindu Marriage Petition No.403 of 2023 pending before the Court of 7th Joint Civil Judge, Senior Division, Chandrapur is transferred to the Court of Civil Judge, Senior Division, Gadchiroli.

Hence, the Misc. Civil Application is allowed.
