Apprehending arrest in connection with Crime No.2672/2016 registered by the non-applicant against four accused (including the applicant), for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code, the applicant seeks pre-arrest bail. The F.I.R. is registered on the complaint lodged by the informant that the accused had opened a bogus branch of bank and assuring informant to give appointment had taken an amount of Rs.25,000/- from him.

The Advocate for the applicant has submitted that two co-accused were arrested and are released on bail. It is further submitted that the applicant is himself a victim and is cheated by the co-accused.

The application is opposed on the ground that

2 aba673.18 the investigation is still in progress and some recoveries are yet to be made.

Be that as it may, considering the nature of accusations against the applicant and accepting the submission made on behalf of the applicant that he is not involved in any other crime / offence, following order is passed:

In the event of arrest in connection with Crime No.2672/2016, the applicant be released on bail on furnishing cash security of Rs.25,000/- (Twenty Five Thousand) and furnishing two solvent sureties for Rs.20,000/- (Twenty Thousand) each.

The applicant shall attend the police station on every Tuesday and Thursday between 10 am. to 3 p.m. till the charge-sheet is filed. The application is allowed in the above terms.

The amount of cash security, which would be deposited by the applicant, be treated as muddemal property and appropriate orders about its disposal / disbursement shall be passed by the trial Court at the time of conclusion of trial.
