Dated : 5 th February, 2015 It is not necessary to adjudicate upon the controversy involved in the present matter, and keeping in view the interest of justice, the following order is passed :

1.

The respondent-tenant is at liberty to get new electricity connection from SNDL, Nagpur after paying the necessary charges, as shall be demanded by the said Company. The Company shall provide electricity connection after being satisfied about the condition without insisting upon no-objection certificate from the petitioner-landlord.

2.

The respondent-tenant has already deposited an amount of Rs.4,160/- towards arrears of energy charges, which are permitted to be withdrawn by the petitioner-landlord. 3.

The respondent-tenant is permitted to withdraw MJC No.67 of 2014.

4.

The petitioner-landlord is permitted to disconnect the electricity supply to the premises of the respondent-tenant with

The petition is disposed of in above terms. No costs. Judge.
