In the present appeal, the appeal was dismissed against the respondent no.2 for not taking necessary steps by the appellants to bring his legal heirs on record. 2.

However, today the counsel for appellants states that he is ready with Civil Application No.3332/2025, accordingly same is taken on record.

The perusal of the application shows that same is filed for recalling of order dated 29.8.2023 and grant of permission to serve respondent no.2 by paper publication. Application is not filed for setting aside abatement, condonation of delay and bringing legal heirs of respondent no.2 on record. Hence, application filed by appellants is misconceived and cannot be accepted.

Learned counsel for the applicants states that he will move appropriate application within seven working days in the matter.

Hence, Civil Application No.3332/2025 is disposed off and liberty is granted to file fresh application. 6.
