This is an application filed under Section 5 of the Limitation Act seeking condonation of delay of 39 days causing in preferring appeal raising challenge to the decree of divorce.

Though non-applicant served and appeared, however no one is present. The reason canvassed for delay is that there was misconception about period of limitation and due to inadvertence delay occurred. It reveals that a decree of divorce has been passed against the applicant lady. The length of delay is just 39 days, in view of that, for the reasons stated in the application and to decide the lis on merits, we deem it appropriate to condone the delay.
