Heard.

In Crime No.245/2015 registered with Police Station Risod, Dist.Washim for an offence punishable under Section 498-A, 306 read with Section 34 of the IPC, the applicants are seeking relief of grant of anticipatory bail.

Seen the police papers produced before me by the learned A.P.P. There are serious allegations against applicant no.1-Raju Prahlad Dhakne. Hence, his application is liable to be rejected. Insofar as applicant nos. 2 to 4 are concerned, I find that applicant nos. 2 and 3 are aged about 75 years. That part, the FIR as well as police papers do not show any overt act on their part constituting an offence against them. In my opinion, therefore, applicant nos. 2, 3 and 4 are entitled to grant of bail.

In view of above, following order is passed.

ORDER

(i) Criminal Application No.630/2015 is partly allowed.

(ii) The application, so far as applicant no.1-Raju Prahlad Dhakne is concerned, is rejected.

(iii) In the event of arrest in Crime No.245/2015 registered with Police Station Risod, Dist. Washim for an offence punishable under Section 498-A, 306 read with Section 34 of the IPC, applicant no.2-Prahlad Anandrao Dhakne, applicant no.3-Sou. Mandodari Alias Mandobai Prahlad Dhakne and applicant no.4-Kum. Tai d/o Prahlad Dhakne be released on bail on they executing P. R. Bond in the sum of Rs.10,000/- each with one surety each in the like amount.

(ii) The applicants shall cooperate with the Investigating Officer in investigation.
