Date : 20 th August, 2016 It is not necessary for this Court to interfere in the order impugned rejecting the application for amendment, which is interlocutory in nature, resulting in stalling the process of the suit. The challenge to this amendment can be raised even in an appeal, particularly when the Court is required to adjudicate on the issue whether there was a due diligence shown by the defendants. Hence, the petition is dismissed. All questions are left open to be agitated in a regular civil appeal, if such occasion arises. Judge.
