3] Mr. Doifode, learned A.P.P. waives service of notice. CRIMINAL APPLICATION NO. 916/2019 This is an application for suspension of substantive sentence and for grant of bail.
2] The applicant is convicted by the learned Sessions Judge, Wardha, vide judgment dated 27/08/2019, in Sessions Case No.273/2013 whereby the applicant is convicted for the offence punsihable under Section 307 and directed to suffer rigorous imprisonment for three years and to pay a fine amount of Rs.2000/- and in default to suffer simple imprisonment for a month.
apeal699.2019.odt 3] It is the submission of the learned counsel for the applicant that after the impugned judgment the applicant had deposited fine amount and also filed an application for suspension of sentence. The said is allowed by the learned Sessions Judge. Statement accepted.
4] In view of the aforesaid, I pass the following order.
ORDER
(i) The application is allowed.
(ii) The substantive sentence imposed upon the applicant in Sessions Case No. 273/2013 dated 27/08/2019 by Session Judge, Wardha shall remain suspended during the pendency of the present appeal.
(iii) The applicant be released on bail on his executing PR bond of Rs.25,000/- with one solvent surety in the like amount. (iv) The application is directed to execute fresh bond before Sessions Court within a period of one month from today. (iii) The applicant shall attend Police Station, Arvi, Distt. Wardha, once in a six month during the pendency of the present appeal.
(iv) The applicant is directed to remain personally present before this Court.
