Sau. Namrata W/O Satish Meshram (Maiden Name Namrata Gulabrao Gajbhiye) v. Shri. Satish S/O Vishwanath Meshram
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
NAGPUR BENCH : NAGPUR Criminal Revision Application No.165 of 2014 (Namrata Satish Meshram V Satish meshram) Office Notes, Office Memoranda of Coram, appearances, Court's orders Court's or Judge's orders or directions and Registrar's orders.
[Shri N.R. Bhishikar, Adv for applicant.
Mrs. Dhole, Adv for respondent] CORAM : A.B. CHAUDHARI, J.
DATED : 08.07.2015.
Heard the learned Counsel for the rival parties.
The revision application has been filed by the applicant/wife for enhancement of maintenance.
The learned Counsel for the respondent has submitted that the applicant is LL.M. and is capable of earning.
Shri Bhishikar, the learned Counsel for the applicant submits that the applicant has a child of three years of age and the receivable salary of the respondent is around Rs. 9,000/- after deductions.
Per contra, the learned Counsel for the respondent states that the respondent is hardly getting Rs.
7,000/- per month as a salary. Taking into consideration the receivable salary of the respondent, I think the enhancement of Rs.1000/- would sub-serve the interest of justice. Hence, I make the following order :- Order A] Criminal Revision Application No.
165 of 2014 is partly allowed.
B] The impugned order awarding interim maintenance of Rs. 2,000/- p.m.
to the petitioner and Rs. 500/- p.m. to the minor child stands modified and in place the respondent shall pay total sum of Rs. 3,500/-p.m. to the applicant Sau Namrata Meshram and to the minor child.
C] Rest of the order is maintained.
JUDGE Deshmukh
