Criminal Application (APPA) No. 799 of 2025 is being filed for grant of leave to file appeal against the judgment and order dated 01/01/2025 in Special POCSO Case No. 323 of 2023, passed by the learned Additional Sessions Judge-12 (Special POCSO), Nagpur, whereby respondent No.2 was acquitted for the offences punishable under Section 354-D of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.

It is submitted that, in view of the proviso to Section 372 of the Code of Criminal Procedure, leave to appeal is not required, as the appellant is the victim. Accordingly, the office is directed to register the appeal 4.

After registration of the appeal, issue notice to the respondents.
