Shri H.N.Verma, learned advocate for the respondent submits that the petitioner has alternate statutory remedy under Section 70 of the Maharashtra Housing and Area Development Act, 1976.

In view of the objection taken on behalf of the respondent, Shri M.P. Sagdeo, learned advocate for the petitioner seeks permission to withdraw the petition with liberty to avail alternate statutory remedy.

The petition is disposed of as withdraw with liberty as prayed for. No costs.
