The proceedings in appeal preferred by the respondent Nos.1 to 4 before the Sub-Divisional Officer under provisions of the Maharashtra Land Revenue Code, 1966 are stated to be pending. In those proceedings various applications were filed including the application seeking dismissal of the proceedings on the ground that the same had abated as some respondents were reported to be dead. According to the learned counsel for the petitioners without considering various pending applications, the proceedings have been closed for passing orders.

We find from the record that the Sub-Divisional Officer on 17/10/2023 has referred to the pending applications and has thereafter observed that the proceedings were closed for passing orders. At this stage the apprehension expressed by the petitioners that the miscellaneous applications preferred by them would not be considered is unfounded. It is expected that when the proceedings are decided finally, due consideration to all pending applications would be given by the Sub-Divisional Officer. 4.
With aforesaid observations, the writ petition is disposed of. Needless to state that if the petitioners are aggrieved by the outcome of the said proceedings, they are free to take legal recourse in that regard. No costs. (Abhay J. Mantri, J.) (A. S. Chandurkar, J.) Asmita
