Shri De, the learned counsel for the respondent No.2 has tendered a Pursis in the Court today. The same is accepted on record. It is stated in the Pursis that the respondent No.2 has withdrawn the representations and the application that were made before the Hon'ble Minister and in which an interim stay was granted, as it was argued that the Hon'ble Minister has no jurisdiction to decide the matter. It is stated in the Pursis that the respondent No.2 would take up appropriate proceedings for challenging the order of the Education Officer.
In view of the statements made in the Pursis, the cause for filing the writ petition would not survive. With the withdrawal of the representations and the application before the Hon'ble Minister, the order of stay would cease to operate.
In the circumstances of the case, the writ petition is disposed of with no order as to costs.
