The learned Counsel for the applicant has contended that one of the co-accused involved in this crime is released by this Court on anticipatory bail while two co-accused are released on bail by the Sessions Court and as such the case of the applicant is at par with those accused. According to the case of prosecution, contraband liquor seized from the vehicle which was driven by the present applicant.

It is not disputed that one of the co-accused is released on anticipatory bail by this Court while two coaccused are granted bail by the Sessions Court. According to the case of prosecution, involvement of the applicant is only with reference to driving vehicle therein liquor was loaded from the house situated in the field of co-accused Govardhan Chiwande. 2 ba959.16 is already released on anticipatory bail by this Court. In that view of the matter, though the chargesheet is yet to be filed, the application is liable to be allowed by imposing suitable conditions as per order below:

The applicant shall be released on bail on his executing P.R. Bond of Rs.20,000/- with one surety in the like amount. The applicant shall attend the Investigating Officer as and when called till filing of charge-sheet. The applicant shall supply proof of residence and shall update the change in the event in future.
