DATED : 19/04/2023 The present application is filed for bringing on record original legal representative of the deceased Balwant Singh Hukum Singh Rihan under Order 1 Rule 10 (2) of the Code of Civil Procedure.

On perusal of the record, it appears that said Paramjit Singh Balwant Singh Rihan was not made party in the claim petition before the Tribunal. Now learned Advocate Harjot Singh Rihan, for cross-objector submitted that he is withdrawing the said application and do not want to proceed with this application. In view of the statement made by the learned Advocate, the Civil Application No.1027/2022 is disposed of as withdrawn.

(2) 84.caf.1027.2022 Civil Application (CAO) No.196/2023 The present application is for bringing on record the address of original respondent No.2 i.e. owner of the vehicle.

The owner of the vehicle in the present appeal is respondent No.5 who appeared before the Court and submitted that he do not want to contest the appeal. In view of that this civil application is also disposed of.

First Appeal No.81/2022 Heard.

Admit.

Learned Advocate Harjot Singh Rihan waives notice for respondent Nos.2 to 4.

Call for record and proceedings.

Appellant to file paper book within eight weeks, after receipt of the record and proceedings. Appeal be placed for final hearing after filing of the paper book, its verification, as per its own turn.
